Public Record Request
Under Nevada Revised Statute Chapter 239, the Nevada Public Records Act mandates that official state records be accessible to the public upon request in a timely manner. Requests must pertain to specific, identifiable records, and agencies are not obligated to create new data or documents to fulfill a request. Certain records, classified as confidential by law, are exempt from this requirement. Requests for general information or answers to questions do not qualify as public records requests. - Per NRS 239.052, the RTAA is permitted to charge a fee for the actual cost incurred in the provision of a public record. This includes, without limitation, electronic records. Costs incurred can include the cost of ink, toner, paper, media, and postage, as well as staff time.
- Of the fee to process the request which fee shall be based upon the actual cost incurred by the RTAA to process the request and shall not exceed fifty cents ($0.50) per page (whether electronic or paper copy).
- If the number of pages of responsive records is initially unknown, as with emails, it shall be presumed for fee estimation purposes that each record (email) is a minimum of one page. As such, if the estimated costs are expected to be over $25.00, the RTAA will require a deposit of at least fifty percent (50%) of the total fee before processing.
- In addition, once the final page count is known prior to the production date, payment in full must be made in order for the RTAA to release the public records, which will be held for 30 days.
- The RTAA may, but is not obligated to, waive all or a portion of a charge or fee for a copy of a public record at the RTAA’s sole discretion.
